Ein Tätowierer aus Lohne bei Osnabrück wollte sich bei der Künslersozialkasse versichern. Seine Argumentation: Die von ihm gestochenen Motive habe er selbst frei entworfen. Die Sozialkasse lehnte ab, wogegen der Tätowierer klagte.

Das Bundessozialgericht gab nun der Künstlersozialkasse Recht. Aufgrund des hohen handwerklichen Anteils beim Tätowieren gelte der Tätowierer als Kunsthandwerker, so wie z. B. ein Goldschmied. Als Künstler gelte nur, wer in Kunstkreisen anerkannt ist.
